MEPS
The number of deputies is 577.
The National Assembly renews
full. The powers of
the National Assembly shall expire on
third Tuesday of June of the fifth
year after his election. Except in cases of
dissolution, the general election
held within sixty days
preceding the expiration of the powers of
the National Assembly.
Members are elected for five years at
direct universal suffrage, ballot
simple majority in two rounds.
The vote takes place by riding. No one is elected
first round ballot if it has met the
majority of votes cast
and number equal to one quarter the number of
registered voters. In the second round
relative majority suffices .
THE MANDATE OF THE DEPUTY
Article 27 of the 1958 Constitution provides
that " any imperative mandate is null .
Voting Members (as
also that of Senators) is personal.
But an organic law authorizes
exceptionally a delegation to vote.
In this case, no person may receive delegation
more than one term.
IMMUNITIES
The Constitution provides for immunities of
substance and procedure to protect the member
cons pressures and maneuvers possible
of the executive:
- substantive immunity :
Article 26, paragraph 1 of the Constitution
that " no member of Parliament may be
prosecuted, investigated, arrested, detained or tried
the opinions expressed or votes cast by
him in the exercise of its functions .
- procedural immunity :
Article 26, paragraph 2, states:
" No member of Parliament shall be
the subject of criminal or correctional
arrest or any other measure
deprivation or restriction of freedom with
permission from the Board of assembly whose
he belongs. This authorization is not required
in case of a felony or misdemeanor or flragrant
final sentence.
Finally, Article 26, paragraph 3, provides that
" detention, deprivation or
restrictive of liberty or the pursuit of
members of Parliament shall be suspended
for the duration of the session if the Assembly
which it is the requires .
